Anti-Money Laundering & Counter-Terrorism Financing (AML/CTF) Compliance

From 1 July 2026, Ayre Real Estate is required to comply with the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth) as a Designated Non-Financial Business or Profession. This page explains why we ask for identification and other information, and how we handle it.

What is AML/CTF?

AML/CTF laws help prevent criminal activity such as money laundering, terrorism financing, fraud, tax evasion and the concealment of illegally obtained funds through property transactions. Real estate businesses that provide certain regulated ("designated") services and supervised by AUSTRAC and must meet obligations set out in the Act.

Why Ayre Real Estate is Requesting this Information

Both the buyer and the seller are considered customers under the AML/CTF Act, and we're required to complete customer due diligence on each before providing certain services, including where we already have an existing relationship with a client. This applies to sales, off-the-plan transactions and auctions alike.

What is Customer Due Diligence (CDD)?

Before commencing a designated service, we're required to confirm who we're dealing with. This includes:

  • Collecting your full name, date of birth and residential address
  • Verifying your identity electronically through our identity verification platform, APLYiD
  • Understanding the nature and purpose of the transaction
  • Assigning a risk rating and applying a level of ongoing monitoring proportionate to the risk

Most identity checks can be completed securely online within minutes.

Information & Documents we may collect

The documents we ask for depend on who's involved in the transaction:

  • Individuals - government-issued photo ID (passport or driver's licence), verified electronically
  • Companies - ABN/ACN details, a current company extract, and identification for directors and any beneficial owner holding a significant ownership interest
  • Trusts (including SMSFs) - the trust deed or a certified extract, and identification for trustees and beneficiaries with a significant entitlement
  • Foreign individuals - passport verification, evidence of Australian address where applicable, and source of funds documentation

When additional checks may apply

Some customers and transactions require a more detailed level of verification under AML/CTF law - for example, foreign nationals or non-residents, politically exposed persons, complex corporate or trust ownership structures, or transactions connected to higher-risk jurisdictions. Where this applies, we'll explain what's required and support you through it.

How your information will be handled

  • Collected only where reasonably necessary to meet our AML/CTF and privacy law obligations
  • Verified and stored using APLYiD, our third-party identity verification provider. APLYiD's Privacy Policy is available at aplyid.com/au/privacy-policy
  • Accessed only by authorised personnel
  • Retained for the period required by law (currently a minimum of 7 years for AML/CTF records) and not held for longer than necessary
  • Disclosed only to government agencies, regulators, our identity verification provider, or others where required or permitted by law

What happens if the requested information isn't provided

If we're unable to complete identity verification, we may be unable to act for you or continue providing services in relation to that transaction. Providing documents promptly helps avoid delays to listing, selling, purchasing or settling.
